1. Application
These Service Terms & Conditions apply to services supplied by Prime Safety & Compliance Services Pty Ltd (ABN 32 698 149 558, ACN 698 149 558) unless a separate written agreement is signed that expressly replaces them.
For each job, the accepted quotation, proposal, work order or written scope (the Agreed Scope) forms part of the service arrangement.
2. Quotations and scope
Quotes are based on the information reasonably available to Prime Safety when the quotation is prepared. A quote may specify the service, number or type of test locations or assets, site requirements, travel, reporting, timing and price.
Unless expressly included, a quote does not include repairs, rectification, remedial works, product supply, coating or anti-slip treatment application, electrical repair work, or other services outside the Agreed Scope.
Additional work or changed site conditions may require a variation or revised quotation. Where reasonably practicable, Prime Safety will explain the additional scope and obtain approval before proceeding.
3. Client responsibilities
The client must:
- provide accurate and relevant information about the site, surfaces, equipment and requested work;
- provide lawful access to the agreed areas and equipment at the scheduled time;
- identify relevant site hazards, restrictions, permits, inductions and access requirements known to the client;
- ensure areas are reasonably accessible and ready for the agreed testing;
- where practical, coordinate the work with occupants, workers, tenants or site representatives; and
- promptly tell Prime Safety about changes that may affect the agreed scope or site conditions.
WHS duties remain with each duty holder to the extent required by applicable law. Work health and safety duties cannot simply be transferred by contract. See the Safe Work Australia guidance on WHS duty principles.
4. Site access and testing conditions
Prime Safety will take reasonable steps to coordinate testing and minimise disruption. Temporary control, isolation or restricted access to the immediate test area may be required for safe setup and testing.
Testing is performed using the agreed or applicable method and conditions. For slip testing, wet and dry methods assess different conditions and may produce different results. The appropriate method or combined scope depends on the surface, location, intended use and agreed requirements.
5. Equipment and calibration
Where applicable, Prime Safety uses testing equipment suitable for the agreed scope. Current website wording states that wet and dry slip-testing equipment is calibrated by ISTS, a NATA-accredited laboratory. Prime Safety is an independent testing provider and is not itself a NATA-accredited laboratory.
6. Electrical services
Electrical Testing & Tagging and RCD testing are performed only within the agreed scope and by a person with the relevant training, knowledge and skills required for the work.
Prime Safety does not undertake electrical repair work unless separately authorised and lawfully qualified to do so. Where repair work is required, the client may need to engage an appropriately licensed electrical worker.
Equipment that fails an applicable inspection or electrical test may be identified and tagged FAILED — DO NOT USE, isolated from use where practicable and reported to the site representative. The applicable result and reason for failure are recorded where within scope.
7. Reports and deliverables
The agreed report may identify test locations, surface or asset descriptions, testing method and conditions, equipment used, measured results, applicable classifications, photographs, observations and agreed practical next-step recommendations.
Reports are generally issued within 24–48 hours after the site inspection where that timeframe is stated in the quotation or agreed scope. Urgent or same-day reporting is subject to prior agreement and availability.
8. Results and limitations
Testing provides results for the locations, assets, conditions and methods included in the Agreed Scope. Results do not automatically establish that an entire site, building or workplace is compliant with every applicable legal obligation, Standard or risk-management requirement.
Prime Safety does not provide guaranteed safety, guaranteed compliance, guaranteed prevention of slips or falls, or any other absolute outcome promise.
Any recommendations are provided within the agreed scope and should be considered alongside the client's broader risk-management, maintenance, engineering, design, legal and regulatory responsibilities.
9. Fees, payment and expenses
Fees, deposits, travel charges, taxes and payment terms will be stated in the quotation or invoice. Unless otherwise agreed, invoices are payable by the due date shown on the invoice.
Reasonable additional travel, access or work costs may apply where the site circumstances differ materially from the information used to prepare the quotation and the additional costs are approved or otherwise properly chargeable under the agreed arrangement.
10. Cancellation and rescheduling
The client should provide reasonable notice of cancellation or rescheduling. Where a late cancellation, failed access arrangement, site closure or other client-related event causes Prime Safety to incur non-recoverable costs or lose a scheduled attendance, a reasonable cancellation, attendance or mobilisation charge may be applied where stated in the quotation or otherwise agreed.
11. Confidentiality
Each party should keep confidential information received from the other party confidential, except where disclosure is required by law, necessary to perform the services, or authorised by the owner of the information.
12. Intellectual property
Prime Safety retains ownership of its templates, systems, methodologies, know-how and other pre-existing intellectual property. Client-specific reports provided under a paid engagement may be used by the client for its internal safety, maintenance, risk-management and compliance purposes, subject to any restrictions stated in the quotation.
13. Liability and Australian Consumer Law
To the maximum extent permitted by law, the parties may agree reasonable limitations of liability in the quotation or service agreement having regard to the nature and value of the work.
Nothing in these terms excludes, restricts or modifies consumer guarantees, rights or remedies that cannot lawfully be excluded or limited under the Competition and Consumer Act 2010 (Cth) and Australian Consumer Law, or any other applicable law. 14. Privacy
Personal information is handled in accordance with our Privacy Policy.
15. Force majeure
Neither party is responsible for delay caused by circumstances beyond its reasonable control, such as severe weather, natural disaster, emergency, industrial action, government restriction, serious site incident, infrastructure failure or other comparable event.
16. Governing law
These terms are governed by the laws of Western Australia and the applicable laws of the Commonwealth of Australia.
